1. Acceptance of Terms
By accessing or using JourneyStorm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
JourneyStorm provides an AI-native EventStorming and domain modeling tool ("the Service"). The Service includes a web-based canvas, AI facilitator features, export capabilities, and related cloud infrastructure. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.
3. User Accounts
You must create an account to use certain features of the Service. You are responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activities that occur under your account; (c) notifying us immediately of any unauthorized use of your account. You must provide accurate, complete, and current information when creating your account. You may not impersonate another person or entity or use a username that is offensive or inappropriate.
4. Acceptable Use
You agree not to use the Service to: (a) violate any applicable local, state, national, or international law or regulation; (b) transmit any material that is unlawful, harmful, threatening, abusive, or otherwise objectionable; (c) interfere with or disrupt the integrity or performance of the Service; (d) attempt to gain unauthorized access to any part of the Service or its related systems; (e) use automated scripts or bots to access the Service in ways that exceed reasonable personal use; (f) resell or commercially exploit the Service without our express written permission.
5. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of JourneyStorm. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JourneyStorm. You retain full ownership of all domain models, journey data, and content you create using the Service ("User Content").
6. User Content & Data
You retain ownership of all User Content you create through the Service. By using the Service, you grant JourneyStorm a limited, non-exclusive, worldwide, royalty-free license to store, process, and transmit your User Content solely for the purpose of operating and improving the Service. We do not sell your User Content or use it to train AI models without your explicit consent. You are solely responsible for the accuracy and legality of your User Content.
7. Payment Terms
Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law or at our sole discretion. We reserve the right to modify pricing with 30 days written notice. If you cancel your subscription, you will retain access until the end of the current billing period. Failure to pay may result in suspension or termination of your account.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
IN NO EVENT SHALL JOURNEYSTORM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date above and, where appropriate, by email notification. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
